TRENDS IN MEDIATION
 
The importance of confidentiality in the mediation process was highlighted recently by an appellate court in Addesa v. Addesa. The court ruled that in order for the process to have a beneficial impact, a mediator must not be subject to subpoena and the mediator’s file shall not be subject to review in the context of future litigation.
 
COLLABORATIVE DIVORCE
 
The Advisory Committee on Attorney Ethics and the American Bar Association have approved of Collaborative Practice as dispute resolution method for matrimonial matters. It is now an option for divorcing couples who, along with their attorneys, agree to resolve their dispute amicably by not going to court. This process encourages the involvement of mental health professionals and financial experts, focuses on the best interest of the children and helps lay the foundation for a healthier relationship after the divorce.
 
GRANDPARENT VISITATION
 
An Appellate Court decision in 2007 has interpreted the Grandparents Visitation Statute to mean that grandparents will not be granted visitation of their grandchildren against the wishes of the children’s parents unless the grandparents prove that such visitation is necessary to avoid harm to the child(ren).
 
CUSTODY
 
A Parenting Coordinator (PC) is a neutral person to whom parents can turn to help resolve conflicts related to parenting issues. The PC may also be empowered by the parents or by Court Order to make recommendations. However, the appellate court in Millan v. Fair (2007) ruled that these PCs may not also serve in the dual role of custody or parenting time evaluators. The scope and nature of these two distinct expert functions present an irreconcilable conflict of interest.
